Yes and no. I don't have a huge problem with the law itself- it is supposed to be used as an aggravating factor in an established crime. It is being used as a crime in itself, which is completely wrong.
British policing has always relied on the common sense of the copper. Your decent copper doesn't nick you for an eighth of hash or for swearing in the street whilst very drunk. He tells you to piss off home, son.
This is where the problem is. The coppers are given targets and at present it is to nail as many hate crimes as they can. You even chief constables openly saying they can't do the job the public wants because they are tied up responding to nuisance hate crime accusations.
