“(1) A person is guilty of an offence if he –
(a)
sends by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or
(b)
causes any such message or matter to be so sent.
(2)
A person is guilty of an offence if, for the purpose of causing annoyance, inconvenience or needless anxiety to another, he -
(a)
sends by means of a public electronic communications network, a message that he knows to be false.
Et cetera.
Regardless of that or any other case that's actually happened I can happily opine on whether the police CPS should get involved in this sort of incident and whether it would be a stupid thing to say via social media. Context determines whether the police should have intervened and I personlly don't think it is very clever to come out with stuff like that on FB or Twitter. Naive? Stupid? Poor judgement? I don't do this, and of course racism and threatening behaviour should be subject to redress. However, much of this section could apply to any form of criticism. It is getting to the point where you cannot say anything which someone says could be interpreted as offensive, especially with regard to religion.
