As I understand it, he's still in jail so I can ONLY assume that further evidence emerges in the final episodes (I still have two to watch) which condemns him in spite of the blatant police stich up.

I can't help but feel something has been left out.

and what the FBI conclude about the blood vial.

As I say below, I assume more evidence comes out against Avery, too. I can't see how he could have gone down based on what we currently know at episode 5.
