Reading more about this Chad Evans case, it becomes pretty obvious why his co-defendant

was acquitted while Evans was convicted.

She is seen on CCTV footage willingly entering the hotel with the other fella who she had sex with first. This alone was presumably considered by the jury as compelling evidence of consent.

There is no such evidence pointing towards consent being given to a second man (Evans) entering the hotel room and having sex with the same woman.

Sex with evans is the video of her being absolutely ****faced entering the hotel- before she had sex with the other bloke.

The crux of the case appears to be that regardless of whst she may have said at the time or before, she was in no fit state to consent. The judge, in summing up, referred to the video as evidence of this. There is not one shred of evidence to suggest thst she was in a worse state when evans entered and therefore her capacity to consent would be the same.
