View Full Version : Yesterday I eceived a Notice of Distress warrant for non-payment of a Magistrate’s Fine

(outstanding amount: £1,045 :yikes: )

After much digging (calls to the DVLA, debt collectors, Magistrates Court) I've discovered that the offence was ā€œfailing to give information relating to the identification of the driver of my vehicle who was alleged to have been guilty of an offenceā€.

According to the Magistrates court's records, the offence took place on 18th May 2013. But on this day I was in France :judge:

Correspondence relating to the offence was then sent to my old address, resulting in me missing the court summons.

Now I have to attend a magistrates court next week to pledge under oath that I did not receive the summons, and then attend a prosecution hearing at a later date.

Presumably as soon as I am able to prove I was out of the country on the day the offence was said to have taken place, the magistrate will throw the case out?

A jumped up member of the community who will take an instant dislike if not complete hatred of you as soon as you enter the room.

You may need to be able to tell them who was driving your car on the day of the offence, that being what they originally wanted to know.

Are you 100% sure that the offence alluded to on May 18th was the actual driving one, and not instead that May 18th was the date by which you had to inform the police etc.

Given your quoted statement of " discovered that the offence was ā€œfailing to give information relating to the identification of the driver of my vehicle who was alleged to have been guilty of an offenceā€.
